Lawyer demands WhatsApp gets rid of the 'lewd' middle finger emoji
Apparently it could be against the law in India and Ireland (Picture: Metro.co.uk/Reuters)

A lawyer has written to WhatsApp demanding that they remove the ‘lewd’ middle finger emoji.

Gurmeet Singh, a lawyer based in Delhi, India, wrote to the tech company ordering them to remove the flipping-off emoji within 15 days, or he would file a civil or criminal complaint against them.

According to Indian broadcaster NDTV, he claims the emoji constitutes an ‘obscene, lewd gesture’ – which is an offence in India.

Singh wrote: ‘Showing the middle finger is not only offensive but a highly belligerent, invasive, obscene, lewd gesture.

‘As per the Indian Penal Code Sections 354 and 509, it is an offence to show obscene, lewd, offensive gestures to females.

‘Use of a lewd, offensive, obscene gesture by anyone is hereby illegal also as aforesaid.

‘As per section 6 of the Criminal Justice (Public Order) Act, 1994, showing of the middle finger is also an offence in Ireland.

‘By offering to use middle finger emoji in your app, you (WhatsApp) are directly abetting the use of an offensive, lewd, obscene gesture.’

Metro.co.uk has contacted WhatsApp for comment.
